Lawsuit Cost Art of Living at least $250,000

August 1, 2012

I don’t think anyone who visits this blog regularly was surprised in the slightest to see Art of Living’s various attempts at trying to spin the outcome of the lawsuit against Klim and Skywalker to make it sound like they – Art of Living – actually won. The sad fact is, there are many severely brainwashed followers who actually believe the various attempts at “damage control” written for example on Bawa & Dinesh and Kashi’s blogs.

The Final Document of the case, which details the settlement between Art of Living and the Does, is available here for download. Of particular note is the following section:

WHEREAS, Parties stipulate and agree and respectfully request the Court to order as follows:

  1. The action Art of Living Foundation v. Does, Case No. 10-cv-5022 LHK is DISMISSED WITH PREJUDICE;
  2. The action Art of Living Foundation v. Eng-An Chou, Case No. 12- 02748-LHK is DISMISSED WITH PREJUDICE;
  3. Each party shall bear its own costs and attorneys’ fees associated with both the Doe Action and the Chou Action, except for attorney’s fees in the amount of $250,000 that Plaintiff Art of Living Foundation agreed to pay to attorney Joshua Koltun as part of the settlement agreement.

If we were to examine this objectively, what this tells us is that the lawsuit which Art of Living brought about against Klim and Skywalker has been “DISMISSED WITH PREJUDICE”. In other words, Art of Living have failed in what they set out to do initially.

It also further tells us that Art of Living have had to incur the costs of both their own attorneys AND the attorneys for the Does. We don’t know how much Art of Living’s own attorney’s fees are, however we do know that the attorney’s fees for the Does cost Art of Living $250,000. From this we can conjecture that Art of Living would have paid out at least a similar amount of money to their own attorney’s, if not more. That’s an estimated $500,000 this lawsuit would have cost them.

This is a staggering amount of money, especially when you consider that Art of Living claims to raise money in the form of donations which supposedly goes towards charitable projects across the world. Evidently, the remit now also seems to include funding lawsuits against those who criticize Art of Living.

So who really won the lawsuit? Well, Skywalker and Klim have both walked away with their identities intact. Neither of them have had to pay any of their own money towards this lawsuit. Art of Living on the other hand have had to pay for both attorney’s fees out of money supposedly set aside for charitable projects. But more than this, they have been unable to unmask the identities of a single person who was included in the lawsuit.

Between this post and the first post on this blog (which also includes Skywalker’s closing comments on the case), all the facts of the case have been stated for all to see. Klim has also provided his own closing comments on the case here and on his own blog here. There is little doubt in my mind as to who actually won the lawsuit, and it’s obvious from reading their closing comments that Klim and Skywalker both feel the same.

However, in spite of all the facts, there will still be those who are unable to accept the truth, who will convince themselves that Art of Living actually won, and who will somehow justify to themselves that the staggering amount of money which Art of Living spent on the lawsuit – which I repeat was money which was raised in the name of charity – was money well spent. But honestly, how much longer can they continue to lie to themselves like this? Eventually, won’t they have to admit the truth, take responsibility and face the consequences of their epic failure? Only time will tell.

It is important to understand why my organization AOL and HH SS Ravishakar pursued this case. We could have ignored it however the legal brains in AOL realized that this blog is affecting our bottom line very badly. AOL’s mask was unravelled in Klim and Skywalkers blog and we have lost our credibility and market share very heavily. All of us know this and among us teachers (at least I have spoken to 20 of them) we have discussed how this has shaken us up and we have brought it to discussion with HHSSRS. We have also told him that we have lost conviction while they talk about Guru grace and miracles which we could so easily cook up and pass on to the gulliable particiapants. The poor attempts through our counterblogs to up our ante are hardly convincing and laughable at best. For those of us who are in AOL for a long time the feeling is that we are caught with our pants down completely exposed. But again having spent the prime time of our lives in this organization we have nowhere else to go but stick on. At lease HHSSRS is rich and can give us a livelihood. We have so many ventures schools, exports/import, real estate.
I am certain and know for a fact that AOL consultants have weighed the pros and cons of pursuing this case. Even if we lost half a million dollars there was a hope of atleast shutting these blogs down so that we can gain some credibility. With internet being so popular in the west and also in India among the middle classes, there was but no option for AOL. The money AOL lost in the lawsuit is not a big amount for AOL overall. It is just the cost of one single foreign tour of HHSSRS.
We know our guru and our conditioned behaviour much better because of these blogs. But at AOL we have to manage and run our business and lives although it is not like old times where we had lot of high hopes.

My friend, if you are not convinced to stay with AOL, dont. No one is forcing you. But if you are staying for wrong reasons, you are going to hurt yourself. Better you get out.

It is now very clear that Ravishankar’s degree certificate is forged. Dr H Narasimhaiah used to sign in Kannada always and he never used to sign in english. Please refer the link below.

Refer the 9th photograph in the link which has a signed portrait of Dr H Narasimhaiah. It is clearly signed in kannada and was signed in 1984. The same portrait is blown up in the National College, Basavangudi in the HN Hall. It is very clear that Bawa and Dinesh have forged the signature. Please expose them and post that signed portrait in your blog.

Wow! Is this “Aol Mole” for real? Or is this a satirical comment? If real– please buddy, just leave. There is life after AOL, really, lots and lots and lots of it! 🙂 And it’s better than your present slave-existence.

Mole, you too could leave and find something else to do. It is not too late even if you are elderly. You sound intelligent and there would be something else for you. Leave AOL behind and be in integrity with your own being.

Why do these AOL folks talk like they know everything and misguide people (esp. Mr. Dinesh Kashikar, who mentions on his blog that AOL won the case). Someone should put a stop to their reckless lies. If anyone from AOL is reading this – stop your high-handed attitude and embrace humility. Above all be straight with yourself i.e. do not deceive yourself to believe things that are not true. The biggest spirituality that you can do to is to be straight with yourself, if you cannot do that, you have wasted your life before you start.
As far as attorney fee is concerned, I am sure there must be some devotee who would have agreed to fight the case for free.

Thanks for the link. The signature is in Kannada and I can confirm this. As you have mentioned it is clear that AOL has forged the degree certificate. A few key points that Bawa and Dinesh overlooked when they were cooking up the certificate through photoshop.

Unlike other Bangalore Univeristy VCs, Dr HN was famous as a freedom fighter, rationalist and thinker. He was a prominent figure in Bangalore and the Bangalore science forum he founded is still famous.Bawa and Dinesh being Mumbai Yuppies do not know about HN and his presence in Bangalore. All they looked at was the VC name during the 70s and they forged the signature. They did not realize that Dr HN studied in a kannada medium school in a village till his 12th standard and hardly knew english till he reached his degree. He has mentioned about his journey of learning the engligh language in his autobiography. His signature obviously is in Kannada and people do not have multiple signatures as someone suggested.

But for AOL folks life will go on because they have mastered the art of lying.
Aol cult members have no qualms about lying.

      @ Kitpati

The interesting part is that they have now placed the certificate’s even on Wikipidia. Its on the AOL website as well.

Should it be a fabricated / fraudulent document……this is an totally awesome bluff that they are attempting to pull off. It could mean significant negative exposure. I am thinking that it went up in multiple places at the same time… would have needed HIS conformance. No ? He knows. And he agreed ???

Are we witnessing heightened paranoia ? Is it fear of total exposure ? Common…I tell myself

      1. Individually or collectively….they cannot be that stupid….I find this really hard to digest that they can resort to such a level.
      2. If they were going to forge it, they could at the very least have gotten the dates right and left no room for further speculation.
      3. From the Scribd document profile of Shri Narasimhaiah it says that he got his PhD in Nuclear Physics from the USA (University of Columbus @ Ohio) in 1960. There are pretty high chances that he also may have had an English Signature.

      1. What you/other readers can do explore….why is the college name not on the certificate ?

      2. If anybody can actually link up with Shri Narasimhaiah’s surviving family and show them the document. See what they say about the signature.

      3. If we can find any Bangalore University / St Joseph College graduation certs in the same period.

This could help seal it beyond any doubt.

46th Annual Convocation of B’lore Univ happened on 15th of Feb, 2011, which was a Tuesday. 47th Annual Convocation of B’lore Univ happened on April 12, 2012, which was a Thursday. 40th convoction reports are there on Newspaper archives dated for a Friday, so its normal to assume that the convocation happened on a Thursday or Wednesday. We could give the benefit of doubt that 7th of Dec, 1975 BU conducted its annual convocation on a Sunday! Perhaps that one year, as a abberation, it happened on a Sunday 🙂

For such a meritorious student who gets triple promotions, don’t you think the university can work extra time on a Sunday to grant the “third grade” degree 🙂

Brilliant observation Guru-ouch !!! Let’s update this on wikipedia.

@ Mangal, that is why I also added, we could give the benefit of doubt to B&D until we have concrete proof. Proofs that we need are
        1. Some ‘X’s BU graduation certificate from the same year as Ravi’s.
        2. That indeed H.Narasimhaiah signs only in Kannada and not both English and Kannada.
        3. That BU indeed conducted its convocation on 7th of Dec, 1975 which happens to be a sunday.

what happened to the certficate mailed by harish to Obi-Kwan?

another idea would be to start a fake employment agency and ask bangalore university graduates in the 50-60 age group to apply for lucrative management positions… that will get you many certificates to compare against.

I have seen the English signature by Dr.H.Narasimhaiah probably in another book ‘Science Society and Scientific attitude’ edited by him. This had a number of essays by prominent rationalists and was a prescribed book by Bangalore University. This was published in the late seventees.

Following link shows another book edited by this illustrious personality, which also contains some of the essays published in Science, Society …… It is a very interesting read.

What is surprising to me is not the English signature, but the prefix of ‘Sri’ to RS’ name on the degree certificate.

It would be interesting to follow the “resurrective acts” that AOL has planned in Assam after Riots. The common motif appears to me that, AOL chooses its activities in disturbed areas that get ample media attention and coverage. But, it would be largely “seva-warriors” spending hours and days of “sevaing”, while the top-brass would choose to make a token-visit amidst the bright lights of media. Its a clever model, where they seek marketing opportunitiesat adverse situations like this.
And yeah, who would have accepted Sri Sri, if he was clad in a Policeman attire or a Corporate attire with a clean shaven, crew cut look? That would not been a “guru-marketing-motif”, after looking at the other successful spirituality business models. Indians especially are so much prejudiced about the outward appearance of an individual and relate it with his/her profession. If an officer at a higher ranking chooses to wear just flip-flops to work and has an unkempt appearance, he is immediately branded as inefficient, even if he works his ass off. Likewise, it would not have been acceptable if Sri Sri was clad in any differently as a spiritual Guru. And once I asked my AOl friend, why is AOL selling pictures where Sri Sri poses with a flower in his hand or besides a Swan etc., for which my AOL friend replied, Sri Sri is enlightened, so he will do whatever his disciples ask him to do. And there was nothing wrong in selling his picture as the organization as such needs money for its maintenance and everyday activities

    Deepika Aradhya,
I don’t consider it “being smart” and “make a little money” to dupe innocent people (like me and many others) into lying for him, telling us that money will go to charities and the poor, when in fact it just went to his sister, her children, and some of his close associates who didn’t mind perpetuating his lies. I, for one, found these types of lies immoral, and so I left. Being afraid that I would tell the truth about him and his dealings, he defamed me, my family, and worse. He just lies about everything that suits him. If you have no problem with lying for him, then go for it — join the group of thieving, cheating, lying AOL Pros. You’ll make big bucks and live well if he likes you to. He even offered that to me to keep quiet. I refused.
